2. General Provisions

These Terms and Conditions of Sale apply to all sales of digital products made through the website Native French Teacher and form an integral part of the contract between the Seller and the Customer.

The Seller reserves the right to modify these Terms and Conditions at any time by publishing a new version on the website.
 The Terms and Conditions applicable to a given order are those in force on the date of payment.

The current version of the Terms and Conditions is permanently accessible on the website and may be consulted by the Customer at any time before placing an order.

Prior to completing a purchase, the Customer is required to expressly accept these Terms and Conditions by ticking a dedicated checkbox and validating the order.
 By doing so, the Customer acknowledges having read and accepted these Terms and Conditions without restriction or reservation.

The Customer declares that they have received all necessary information to assess the suitability of the products for their needs and that they are legally capable of entering into a contract or validly representing the person or entity on whose behalf the purchase is made.

Unless proven otherwise, the electronic records stored by the Seller constitute proof of all transactions carried out via the website.

3. Eligibility and Scope of Sales

The products offered on this website are available for purchase worldwide, to both individual customers and business customers (schools, institutions, companies and self-employed professionals).

4. Products

The products offered for sale on the website are digital pedagogical resources designed for teaching and learning French as a foreign language.

These products may include, either individually or as part of a pack:

  • PDF documents (worksheets, lesson materials, digital books),
  • audio files (original recordings of the seller’s voice),
  • and any other associated digital content.

All products are delivered digitally. No physical products are sold at this stage.

5. Prices and Payment

Prices are displayed in euros and are final. In accordance with the Italian forfettario tax regime (Art. 1, paragraphs 54–89, Law No. 190/2014), the Seller operates under a VAT-exempt scheme: no VAT is charged and no VAT is added to the prices shown. Payment is processed securely via Stripe. Orders are confirmed only after full payment has been received.  

6. Delivery of Digital Products

Digital products are delivered immediately after payment via automatic download or by email.
The Customer is responsible for providing a valid email address and ensuring access to the delivered files.

7. Right of Withdrawal – Digital Content

In accordance with EU consumer law, the right of withdrawal does not apply to digital content supplied immediately after purchase, provided that the Customer has expressly agreed to the immediate supply and acknowledged the loss of the right of withdrawal.

This exclusion applies to all digital content, including PDF documents and audio recordings.

By completing the purchase, the Customer expressly agrees to the immediate delivery of the digital content and acknowledges that no refund or exchange is possible once access or download has begun.

8. Refund Policy

Due to the nature of digital products, all sales are final.
No refunds, cancellations or exchanges are possible once the digital content has been delivered.

9. Intellectual Property, Educational License and Metadata

All digital products sold on Native French Teacher, including PDF documents and audio recordings, are protected by copyright law and remain the exclusive intellectual property of Emilie Blanc.

Audio recordings are original works featuring the seller’s voice and are protected as such.

The purchase of a digital product grants the Customer a personal, non-exclusive, non-transferable educational license.

This license allows the purchaser to:

  • use the materials in their own classes or lessons,
  • play the audio recordings for their students,
  • display or print the PDF materials for classroom use,
  • distribute printed copies to their own students for educational purposes.

This license does not allow:

  • sharing the digital files (PDF or audio) with other teachers or colleagues,
  • distributing the content to schools, institutions or online platforms,
  • reselling, sublicensing or making the content publicly available,
  • reusing the audio recordings (including the seller’s voice) to create new teaching materials, recordings or derivative works,
  • using the content for collective or commercial purposes beyond the purchaser’s own teaching activity.

Metadata and Content Protection

In order to protect the digital products against unauthorized distribution, the PDF files and associated digital content may contain metadata or invisible identifiers related to the purchaser (such as name, email address or order reference).

These metadata are used solely for copyright protection and traceability purposes and do not affect the normal use of the products by the Customer. The Customer is informed of the presence of these identifiers at the time of purchase by acceptance of these Terms and Conditions

Any unauthorized use constitutes a breach of these Terms and may result in the immediate termination of access without refund and, where appropriate, legal action.

10. Liability

The Seller shall not be held liable for any indirect or consequential damages resulting from the use of the digital products.
In any event, the Seller’s total liability shall be limited to the amount paid by the Customer for the product concerned.

11. International Sales

The products are sold worldwide.
The Customer is responsible for ensuring that the use of the products complies with the laws and regulations applicable in their country of residence.

12. Personal Data

Personal data is processed in accordance with the General Data Protection Regulation (GDPR).
Further information is available in the Privacy Policy published on the website.

13. Governing Law

These Terms and Conditions are governed by Italian law.
Mandatory consumer protection rules applicable in the Customer’s country of residence shall remain unaffected.
